These limitations apply regardless of the legal theory upon which the claim is based, including negligence, strict liability, breach of contract, breach of warranty, or any other legal or equitable theory, and even if Pequod's Pizza has been advised of the possibility of such damages. Unless both you and Pequod's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
12.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
